COURT: Minister Kania can file additional affidavits

Arua, Uganda | THE INDEPENDENT | The High Court in Arua has allowed the State Minister for Lands Obiga Mario Kania to file five additional affidavits in defence of an election petition against him.

The court’s decision follows a preliminary hearing of the petition on Friday in which Apama Amato Boroa one of the contestants in the January 2021 Parliamentary Elections for Terego East petitioned the court seeking nullification of Kania’s victory on grounds that four of the academic documents he presented for nominations bear different names.

Two weeks ago, Kania through his Lawyers Ederu and Gama Advocates presented to court five additional affidavits from people confirming to have studied with him. However, Boroa‘s lawyer Jimmy Madira of Madira and Company Advocates demanded that the court rejects the additional affidavits.

On Friday, Justice Boniface Wamala ruled that filing of supplementary affidavits is not time-bound given the Covid19 lockdown situation that also restricted the movement of persons. Justice Wamala urged Boroa to instead file additional evidence to attach his petition.

Court has granted Boroa up to Monday next week to prepare and file additional evidence to counter the five supplementary affidavits filed by Kania before a hearing of the petition is scheduled.
