Kampala, Uganda | THE INDEPENDENT | A parent has dragged Kibuli Secondary School to Court for suspending her daughter who was accused of stealing sugar.
The parent, Barbara Lubwama Nakku contends that her daughter was illegally suspended indefinitely from the school after being coerced by the matron to confess to sugar theft. the Matron, Christine Nalwadda reportedly battered the student and put her under duress to write a letter to the School’s Disciplinary Committee confessing to the theft.
Through her lawyers; Mugisha, Namutale and Company Advocates, Nakku contends that her daughter was indefinitely suspended from the school during the second term of her Senior Two studies but the suspension was never disclosed to the parent until after she had cleared third term school fees.
Nakku says that she was called on September 19, 2019, and advised to pick her daughter on September 23, on grounds that she had been indefinitely suspended for a crime allegedly committed in the middle of the second term. She adds that the daughter was suspended on baseless accusations.
“The impugned decision of the respondent of issuing an indefinite suspension with effect from September, 23rd, 2019 was highhanded, illegal, and done in total disregard of the principles of natural justice and provisions of the Constitution of Uganda”, states the suit filed before the Civil Division of the High Court.
The parent now wants the High Court to quash the suspension of her daughter and make a declaration that the dismissal was illegal.
The Board of Directors Kibuli Secondary School have been summoned to file their defence before the matter is allocated to the Judge who will fix it for hearing.
