SUBJ: REPORT ON RWANDESE ASYLUM SEEKERS IN MBARARA
INTRODUCTION
1. Early this year a number of RPA officers and men entered Uganda claiming to be fleeing from persecution. Concern was raised on the frequency of arrivals and various steps were taken to respond to the problem.
AIM
2. The aim of the report is to brief Your Excellency on the developments of the asylum seekers issue and steps taken so far.
STEPS TAKEN

a. Having been overwhelmed by the frequency of arrivals of RPA officers and men, I wrote a letter to AC highlighting Military Intelligence limited capacity to receive and manage them in terms of accommodation and feeding. The letter reference UPDF/MI/9S of 14
May is attached here to. Marked Annex A.
b. AC inscribed on the face of that letter instructing me to handover all these cases to UNHCR citing your Excellency’s instructions on the matter (Ref Annex A) .1
c. In accordance with AC’s orders a list of all the asylum seekers was compiled and forwarded to UNHCR for action. (The letter ref UPDF/MI/9S of 21 June 01 marked Annex B is attached).
d. UNHCR and the refugee eligibility committee of Prime Minister’s office rejected their application to be granted refugee status on the ground that they were not persecuted in Rwanda. It was decided that they be repatriated back to Rwanda. (Ref to JIC minutes of July 17th marked Annex C and letter to Minister of disaster preparedness of 03 July 2001 marked CI.
e. That decision was communicated to the asylum seekers and all relevant authorities in Mbarara to arrange for their deportation. When the DIsa had brought a vehicle to take them to the boarder, their leader, Pastor Deo Nyirigira reportedly rang Brig Kazini who immediately stopped the process (Ref to letter from DDG-ES0 to Ag CMI D6/5/2001 of 20 Jul 01 attached as Annex D.
f. The COS by way of verbal instruction through his ADC instructed CMI to continue looking after these people (accommodation and feeding).
g. On 01 Aug 2001 I wrote to COS stating that Military Intelligence had neither the resources nor the government mandate to keep them as the task falls under Ministry for Disaster Preparedness (Ref UPDF/MI/9S of 01 Aug 01 marked Annex E.
h. Inspite of my communication to COS no action was taken and the groups perennial problems of welfare continued. Reports were coming incessantly to me and I was under extreme pressure to continue keeping these people.
j. On 3 Sept 2001 I again wrote a reminder to COS so that he allows their deportation to get this problem off our hands. (Ref UPDF/MI/9S marked Annex F).
k. So far I have not received any reply from COS and the problem is not yet resolved.
CONCLUSION
All available avenues were taken by ourselves, but we have been blocked by the actions of COS who should be prevailed upon to allow the process of repatriation to go on.
