Justice Kibuuka Musoke has ordered the Chief of Defense Forces, Aronda Nyakairima, to produce five treason suspects in High Court on July 31.
Kibuuka has also ordered Nyakairima, James Mugira, the Chief of CMI and Attorney General Khidu Makubuya to appear before court on the same date, at 9am.
The three government officials are wanted in High Court in connection with the illegal detention of the five treason suspects.
The suspects are Abdurrahman Kijjambu, Ismail Kambaale, Abdul Lugemwa, Mohammed Sekulima and Fatuma Nantongo.
Human Rights Lawyer, Ladislaus Rwakafuzi, made the application to court to have the suspects, who have been held for over a year, to be produced for trial.
The application stems from an April 2009, Human Rights Watch Report in which the Chief of Military Intelligence, James Mugira confirmed in a letter to the Human Rights Watch that they were holding Abdurrahman Kijjambu, Ismail Kambaale and Abdul Lugemwa.
In the letter, James Mugiira denied knowledge of the whereabouts of Mohammed Sekulima and Fatuma Nantongo.
Speaking to Uganda Radio Network, Ladislaus Rwakafuzi revealed that prior to the applications the relatives of the suspects had sworn affidavits but were not in court because they too fear for their lives.
Rwakafuzi, told court that he doesn’t know where his clients are being detained but added that Mohammed Sekulima and Fatuma Nantongo were being moved to different places.
According to Human Rights Watch, Abdurrahman Kijjambu and Ismail Kambaale from Nakawa were arrested on July 12 and 13, 2008 respectively.
The two were accused of being part of an urban hit squad that was planning to attack Kampala. While Abdul Hamid Lugemwa from Rakai district was arrested in March 2008.
Mohamed Sekulima, alias Bidomola, and Fatuma Nantongo were arrested in May and December 2008 respectively. The duo is being held at Jinja road police station for terrorism.
Rwakafuzi also promised he was going to apply to court to order for a public hearing (public inquest) into the death of Saidi Lutaaya another ADF suspect who died in the custody of CMI.
According to the Human Rights Watch, Saidi Lutaaya was arrested by CMI operatives who hit him on the head with a hammer during interrogation. He died later in Mulago hospital where he was rushed in critical condition.
Human Rights Watch said in their statement they had obtained a death certificate, indicating that Lutaaya had died as a result of torture.
